Trust Administration
As discussed elsewhere on this website, one may avoid a time-consuming, costly, and public Conservatorship and Probate by having an Estate Plan that includes a properly funded Revocable Living Trust. (See Conservatorship, Probate, and Wills, Trusts, & Estate Planning.) A Revocable Living Trust must be properly administered when the person who created it loses capacity or dies. Trust Administration is the process of administering a trust and carrying out its terms, either to manage the assets for the benefit of the person who created the trust after he or she loses capacity or to distribute the assets after his or her death.
Although Trust Administration requires some time commitment and expense, the time commitment and expense of a Trust Administration generally is far less than that of Conservatorship or Probate. Further, in contrast to Conservatorship and Probate, Trust Administration normally is completely private.
