Conservatorship

A Conservatorship is a court proceeding through which a person (i.e., the Conservator) is appointed to manage the affairs of another person who lacks physical and/or mental capacity to do so for himself or herself (i.e., the Conservatee). Many people avoid the time commitment, expense, and publicity of a Conservatorship by creating an Estate Plan before losing capacity. (See Wills, Trusts & Estate Planning.) For someone who does not have an Estate Plan and lacks capacity, however, a Conservatorship usually is the only mechanism available to empower someone to protect him or her from fraud and abuse and to manage his or her assets, income, and personal care, including medical decision-making.
